I want to use cafepress to sell some stuff on my site. It's a fansite of an actor and his band.

Now, I know it's illegal for me to sell photos of them, but is it illegal for me to sell an item with their photo? Or their name, for instance "Fredalba Rocks"?

Is it leagl to just put my site name on the items (even though it has the name of the actor ex: actorname.net)? I know some people who sell items with site names and features the actor/band name? What if I wanted to put "mysitename.net #1 source, blah, blah, blah" is that ok?

I just want to make sure of things before I go about them and get in trouble, you know! Thanks :)

It's not okay if you don't have legal permission from their agent.

so even if i just put (the name of my site) and (the actor name) it would still be ilegal?

probably yes.

because it shows you are "using" his name or the band name which is probably copywrite.

you must get express permission from the agent to do anything with images or names of the band. write to them and explain exactly what you want to do specifically and they may answer.

yea, you should probably contact them.. ALTHOUGH they'd probably wonder: how much you're charging for each item, what items are you going to put their photos on, quality, size... so be sure to decide all that first. and also, since you're using THEIR material, don't be shocked if they want a percentage of your income.. altho they probably wont, but who knows :)

That's one of the biggest issues as well. I don't know about just e-mailing them. You'd probably need legal documents in your hand.
