ok i read the neopets Terms of use for their images... im currently making a neopets site and i wanted to make a banner... my question is ...

1. isnt a banner a link or picture that other people has on their site that will link back to ur site? like a pictures u created and put on ur site and so other people can put it on theirs and then link back to you.

2. if question one is true then what if neopets says u cant make any banners/backgrounds with their images, can u still do so? because i saw some neopet fansites that has banners containing neopet pictures, so if they do so can i also make banners/backgrounds with neopet pictures?

I made a banner using neopet pictures, but I didn't take them right off from neopets. Their are a ton of sites out there that have used neopet images, but they simply just turned around and named them different to make them look like they were their images in the first place, but of course neopets had them. I don't think they will do anything about it unless they find out, and since you said theirs a ton of neopets sites out there I wouldn't worry, because I doubt neopets has the time to go around shutting down all the sites or complaining about them when they have too much time on their hands adding updates to the site. Yes, a banner, or a button if you like, can be put on other peoples sites to link back to yours. Also, when they say you can't make banners, it means you can't claim the banner and the Neopet on it as your work. I believe that as long as you have a disclaimer on your site that gives Neopets the rights to any Neopets image you use, then it's acceptable.
